I have a lawyer that is going to answer the most frequently asked question regarding being arrested. Look, if you are arrested-IT DOESN’T MEAN YOU ARE GUILTY IT IS JUST A CHARGE but of course someone’s ANGELS on the other thread that are so perfect (WE WILL SEE HOW PERFECT THEY ARE THIS COMING FRIDAY) think and say otherwise.

Personally, I don’t have that much interaction with the police. I have had some with Cheshire AND YOU KNOW WHY!!! If you are arrested KEEP YOUR MOUTH SHUT!!! PERIOD!! The police don’t like it but that is your right.

Here is the Question: WHAT SHOULD I DO AND WHAT SHOULDN’T I DO IF I AM ARRESTED??

There are many things you can do once you have been arrested that will ensure that your rights are not violated. Some of the things you should do include:

  • Remain silent – you do not have to answer any questions the police ask you and anything you say can be used against you in court
  • Be polite and respectful towards the police officer(s)
  • Remain calm
  • Contact your attorney or ask for one and don’t say anything until they are present
  • Try to remember the badge numbers of any officers you are involved with, as well as their patrol car number(s)
  • EDITOR’S NOTE ON ABOVE COMMENT: HA!! FAT CHANCE IN CHESHIRE. IF YOU ARE GOING TO ASK FOR THE BADGE NUMBER OR NAME, MAKE SURE YOU ARE WEARING A HELMET!!!
  • Make sure that your attorney is present for any questioning
  • Make sure that your attorney is present for any lineups or testing (such as drawing a blood sample)
  • Let your attorney deal with the police and any prosecutors, especially if they offer you some kind of deal
  • If you are injured, be sure to take photographs of the injuries as soon as possible and get medical attention
  • Try to find witnesses and get their contact information (name, phone number)

If you are arrested, many things that you do can have negative effects on the outcome of your case. To ensure that your rights are protected:

  • Do not say anything about the incident to the police.
  • Do not mouth off to the police or do anything to upset them. IMPORTANT!!!!
  • Do not attempt to run from the police-you will likely be caught and it will not look good in court.
  • Do not say anything about the incident to anyone besides your lawyer (this includes cellmates if you are in jail).
  • Do not give the police permission to search anything.
  • Do not resist arrest , even if you are innocent, resisting arrest can lead to increased charges. In particular, do not touch the officers in any way.
  • Do not believe the things the police tell you in order to get you to talk -the police are allowed to lie to you and often times will tell you it will be easier on you if you just tell the truth. It will only make it easier for the police to prove their case.
  • If the police come to your home, do not let them in unless they have a warrant and do not go outside. It may be that they need an arrest warrant to arrest you in your home and if you go outside, you may be arrested without a warrant.
  • If the police arrest you outside your home, do not allow any officer to go into your home to get clothes, talk to your wife, etc. If you accept, the police will escort you into your home and begin to search it without a warrant. The same applies to your car.
  • Editor’s Note: I wonder when the Town Government is going to take the reins on this Police Department and start getting involved. “Oh the Chief said this is OK and that is OK so I guess it is OK”

    NO TOWN MANAGER NO TOWN COUNCIL IT IS NOT OK!!! You see what is starting to happen. Things are falling apart. We did not need to spend $5,000 to see this-IT IS OBVIOUS!! Believe me, I have taken more of an interest in this Police Department then the Town Manager and the Town Council COMBINED!!

    Also, I did want to address this Heart and Hypertension issue that the Town of Cheshire (and probably other towns also) spend $300,000 a year on. Remember if this were a teachers heart and hypertension WE WOULD NEVER HEAR THE END OF IT FROM SOME OF YOU!!! Different strokes for different folks!!!

    And now we have the Police Chief trying to crack the whip but it is TOO MUCH TOO LATE!! You can’t come in like gangbusters and expect positive results. This has to be done slowly. The Chief SHOULD HAVE CALLED any rank and file officer into his office to DISCUSS ISSUES!! THE DOOR SHOULD BE OPEN ALL THE TIME!! LISTEN TO WHAT THESE PEOPLE HAVE TO SAY WITHOUT AN ATTITUDE!! GET IT!!!

    There is nothing worse and take it from me I have had WELL OVER 100 jobs in my lifetime AND I CAN PROVE IT. I have worked for many many companies. There has to be STRUCTURE. THERE HAS TO BE A PURPOSE AND A GOAL (AND ONE OF THE GOALS SHOULD NOT BE CLICKING ON UTH ALL DAYAND NIGHT).

    People have to know what they are supposed to be doing and what it is accomplishing to be productive. Not “go out there and get your quota.”

    There is accountability but it is AFTER THE EVENT TAKES PLACE AND IT IS IN PRIVATE!! I am sure this Officer got a tongue lashing. But we will never hear a statement from the Town Government that “we looked into it” or anything.  No, the  Town Manager will ask the Chief if everything is OK. WHAT DO YOU THINK HE IS GOING TO SAY?? NO IT ISN’T???

    I am going to sit down with the Chief and we are going to look at this video tape and I AM GOING TO TELL HIM WHAT I THINK!!

    BUT NEVER NEVER NEVER SAY ANYTHING TO THE COPS AND DON’T POINT AT THEM. EVER!!

    EVEN IF YOU ARE BOILING MAD-JUST SHUT DOWN AND SHUT UP!!!! DAMN DID YOU LEARN NOW????

    The Town of Cheshire should really monitor that Topix thread because there is another statement on there from a blogger TIME2GOHOME stating the Town apologized to the person involved in the throwdown incident. There is also a massive amount of slander. This again is why I DO NOT ALLOW COMMENTS TO BE POSTED BEFORE  THEY ARE LOOKED AT!!!
