I did get a response on Tuesday from the Town Managers office regarding this POSSIBLE Hipaa violation on the part of the Cheshire Police Department and this supposed time discrepancy on their report of the event.
I am really not going to get into details because I know the Town Attorney Dwight Johnson is looking into this Hipaa situation but I also have people looking into it on my end and the if this does come to fruition, there could also be a Fourth Amendment violation as well.
The other side has one “time” logged into their computer-the time the call came in-I was told that was the official “time” of the call-but without going into further detail because I don’t want the other side to gain an advantage, the “timing” is crucial to this investigation.
UPDATE: I WANT TO CLARIFY THE ABOVE STATEMENT. THE OFFICIAL TIME OF A POLICE CALL IS WHEN THE PATROL CAR ARRIVES ON SCENE. SORRY FOR THE MISUNDERSTANDING.
Instead of getting new equipment all the time that they obviously don’t know how to use, GET SOME MORE TRAINING IN PEOPLES CIVIL AND CONSTITUTIONAL RIGHTS AND HOW NOT TO VIOLATE THEM!!
The Hipaa is very serious and I don’t mean any disrepect (OH WHO AM I KIDDING YES I DO), but I don’t think the Chief of Police realizes what happened that day of the incident and how serious this is.
I told Michael Milone the Town Manager that I BELIEVED the AMA article I ran a link to on the “It Finally Happened” post, that the police and medical emergency personnel are given more leeway than physicians with Hipaa, but with the police I believed the article to mean that they may use a persons name IN AN INVESTIGATION: i.e. “we are looking for Jane Doe, she may be ill” etc, etc.
BUT, I believe the name CANNOT BE USED IN CONJUCTION WITH A MEDICAL ASSIST CALL BEING MADE OVER THEIR RADIO SYSTEM,
When I used to go to the CPD to get the Summary Call logs, any medical assist call (for an ambulance or the like) the address was listed, BUT THE NAME WAS REDACTED OUT!!
If any of you have been in an ambulance at any time in your life, you notice the medical personnel NEVER SAY THE NAME OF THE PERSON THEY ARE TRANSPORTING TO THE HOSPITAL.
They say something to the effect” “we are en route with a white male 56 years old, with a stab wound to lower abdomen, etc etc, THE NAME IS NEVER EVER SAID because they DON’T KNOW WHO MAY BE LISTENING AND IT IS HIPAA VIOLATION!!!
Well this issue will be pursued so somebody better do a lot of digging into the law, because I am also. If the town stopped defending these people all the time, maybe it would not have come to this
WHAT IS THIS COSTING?? ANSWER: TOO BAD!! GET MORE TRAINING NOT MORE EQUIPMENT!!
